In the first half of 2026, venture capitalists poured more than $14.6 billion into defense AI startups—exceeding the entire previous year's record of $9.6 billion—funding companies that will decide how autonomous drones select targets, how surveillance systems track citizens, and how military command systems make life-and-death decisions. Defense tech startups have announced 107 venture rounds so far this year, putting 2026 on pace to far surpass prior funding records. More than 60 defense-tech companies have raised over $33 billion in total, with generative AI and large language models transforming intelligence analysis, mission planning, and predictive logistics.

AI labs are now effectively part of the national security ecosystem, with OpenAI becoming eligible for the 2026 NatSec100 ranking after securing at least one U.S. government contract by end of 2025. Yet these firms answer to private investors hunting returns, not to the public that will live with the consequences. Beyond defense-specific firms, autonomous robotics is surging: Prometheus raised $12 billion in a Series B round for physical AI, while NEURA Robotics raised up to $1.4 billion in a Series C round. U.S. robotics venture capital reached a record $4.9 billion in 2025, with the 2026 landscape dominated by large humanoid and autonomous systems rounds.

Fundable AI patterns in defense tech focus on mission-execution tools—autonomy, command workflows, planning, code verification, and decision support—capabilities at the heart of military operations. Sovereign AI platforms, where states retain full control over data residency, infrastructure ownership, and model development free from foreign commercial influence, are a growing category. For high-security defense workloads, these systems must be air-gapped, functioning entirely offline on agency-controlled hardware with no queries routed to commercial inference servers.

The Pentagon is increasingly seeking these startups as suppliers to diversify beyond traditional prime contractors like Lockheed Martin and RTX, aiming for cheaper weapons and more competitive bids. These aren't typical software companies but firms building critical state security infrastructure.

The Accountability Gap

Democratic accountability concerns center on lack of transparency about how commercial AI is used by the Department of Defense, the absence of robust legal safeguards against misuse, and threats to both privacy and national security. Key oversight questions include whether AI models could conduct domestic mass surveillance, under what circumstances companies might acquiesce to unlawful DoD uses, and what responsibility companies have to notify Congress of such acts.

Senators are demanding answers on how generative AI companies engage with DoD, the rules governing access to their technology, and the internal controls preventing misuse. Senator Kirsten Gillibrand stated: "We need clear rules for how our military uses AI". Private military contractors and AI startups often operate in legal and oversight gray zones, with accountability levels varying across administrations and frequently failing to ensure transparency and ethical governance.

"Without stronger safeguards, oversight, and mechanisms for individual redress, national security uses of AI risk undermining civil rights and civil liberties despite rhetorical commitments to responsible use". Seventy-two percent of adults harbor doubts about AI, fueling calls for greater oversight and regulation as trust in emerging technologies declines.

Technical Safeguards Are Not Democratic Legitimacy

Defense tech startups operate in highly regulated environments with strict government standards for reliability, security, and procurement. Accountability mechanisms rely on human-in-the-loop governance, mandatory legal reviews, independent technical audits, and compliance with federal cybersecurity frameworks like CMMC and NIST. Every new military AI system must undergo recurring legal review to ensure compliance with International Humanitarian Law, requiring transparent records with signatures from legal, technical, and operational authorities. Blind implementation of AI recommendations is prohibited under CMMC accountability rules, which require qualified personnel to review outputs before action. "The administration's push to strip away safeguards and punish companies insisting on guardrails undermines U.S. security and American values by disregarding mechanisms for legal oversight and technical validation". Senator Ron Wyden's proposed Algorithmic Accountability Act would demand rigorous testing of high-risk AI and stronger transparency and bias safeguards.

Who Controls the Tools of State Power?

When AI touches core state interests like military power and national security, governments increasingly reject private autonomy, effectively capturing firms whose technology is critical. The U.S. Department of War has designated American AI companies like Anthropic as supply chain risks to national security, a move previously reserved for adversarial firms, signaling a shift toward state primacy over private AI governance. A framework signed in December 2025 by nine nations including the U.S., UK, Japan, and Israel formalizes that AI chips and models are strategic assets managed through alliance structures, with access conditional on political alignment.

The companies raising billions in 2026—Anduril, Shield AI, Saronic, Cyera, and others—will likely define democratic nations' security capabilities for decades, yet they remain accountable primarily to investors seeking returns. What's missing is public input into which AI capabilities should be developed, transparency requirements that allow citizens and Congress to scrutinize use cases, and democratic debate over the ethics guiding autonomous weapons and surveillance tools. As defense AI startups rapidly scale from venture backing to operational deployment, the window for establishing democratic guardrails is closing—raising the urgent question of who will govern these critical tools and what safeguards democracy requires.
